2. TERMS AND CONDITIONS OF SALE: TARGETLINE LIMITED

2.1 Definitions

The ‘Buyer’ means the person that is named on the invoice.

‘We’ means ‘Targetline Limited’ otherwise referred to as Targetline.

‘End User’ refers to the person who will use the goods; this is not necessarily the Buyer.

2.2 Terms and Conditions of Sale

The Buyer agrees to pay Targetline for the goods.

The goods as detailed on the order will be despatched upon receipt of cleared funds from the buyer, to the address specified on the order.

2.3 Variations

Whilst every care is taken by Targetline to describe all products as accurately as possible there may be variations between the products shown and detailed on the website http://www.targetline.co.uk/ and the actual product received.

2.4 Receipt of Products

Once the products are received by the Buyer, it is the Buyer’s responsibility to read and understand the instructions accompanying the products prior to use of any Targetline products and relay these instructions to the End User if it is not the Buyer.

In the event that any instruction is not understood or if there are any queries as to the use of the products then the products must not be used until such time the buyer is satisfied as to the correct use of the product.

In the event that instructions are not included with the products, please contact sales@targetline.co.uk who will provide a copy of the instructions.

Targetline accepts no responsibility for any loss arising out of negligent use of the product by the end user or by any third party.

2.5 Use of Products

All Targetline products, unless otherwise stated, are for the intended use only. They must not be modified or changed in any way otherwise this will immediately invalidate the warranty.

It is the Buyer’s responsibility to ensure that the products are used in accordance to the instructions supplied and Targetline cannot accept any responsibility whatsoever for any loss or injury resulting from the proper or improper use of their products.

Targetline cannot accept responsibility whatsoever for any damage or loss caused to any third party equipment as a result of the installation of a Targetline product.

2.5 Limitations

Targetline shall not be liable under or in connection with these Terms and Conditions in contract, tort, and negligence or otherwise for any damages or consequential loss whatsoever.

2.6 Disclaimer

The information contained in this website is not comprehensive. Despite our efforts, it may not be accurate, up to date or applicable to the circumstances of any particular case. We cannot accept any liability for any inaccuracies or omissions in this website and any decisions you make based on information contained in this website are your sole responsibility.

2.7 Refunds

Targetline provides a money back guarantee if you are not satisfied with any of the products as long as a written request is made within 10 days of receiving a product and the products are returned in a saleable condition, unused and in their original packaging.

We regret that we are not able to refund on a bespoke item made to a customer’s specification unless the item is faulty and beyond repair by Targetline.

Bespoke items that can be resold may be returned for a 20% restocking and handling charge.

Your statutory rights are unaffected.

2.8 Applicable Law and Jurisdiction

The operation of these terms and conditions shall be governed by and construed in accordance with English Law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the English courts.

2.9 FORCE MAJEURE

Targetline shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

14 CHANGES TO TERMS AND CONDITIONS

Targetline shall be entitled to alter these Terms and Conditions at any time. But this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.

3.1 ACCESS and Use

Your access to and use of Targetline Limited ("the Website") and the Services outlined in Clause 3.3, are subject exclusively to these Terms and Conditions. You will not use the Website/Services for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website/Services you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website/Services.

3.2 Variations

Targetline Limited reserves the right to update or amend these Terms and Conditions at any time and your continued use of the Website/Services following any changes shall be deemed to be your acceptance of such change. It is therefore your responsibility to check the Terms and Conditions regularly for any changes.

3.3 THE SERVICES

The Website may provide communication tools such as email, bulletin boards, chat areas, news groups, forums and/or other message or communication facilities ("the Services") designed to enable you to communicate with others. Unless stated otherwise the Services are for your personal and non-commercial use only.

3.4 CHILD SUPERVISION

Targetline Limited is concerned about the safety and privacy of its users, particularly children. Parents who wish to allow their children access to and use of the Website/Services should supervise such access and use. By allowing your child access to the Services you are allowing your child access to all of the Services, including email, bulletin boards, chat areas, news groups, forums and/or other message or communication facilities. It is therefore your responsibility to determine which Services are appropriate for your child. Always use caution when revealing personally identifiable information about yourself or your children via any of the Services.

3.5 USER ACCOUNT, PASSWORD AND SECURITY

If a particular Service requires you to open an account you will be required to complete the registration process by providing certain information and registering a username and password for use with the Services. You are responsible for maintaining the confidentiality of the username and password and also for all activities that take place under your account. You agree to immediately notify Targetline Limited of any unauthorised use of your password or account or any other breach of security. In no event will Targetline Limited be liable for any indirect or consequential loss or damage whatsoever resulting from the disclosure of your username and/or password. You may not use another person’s account at any time, without the express permission of the account holder.

Targetline Limited does not control or endorse the Content and cannot guarantee the accuracy, integrity or quality of such Content and you acknowledge that by using the Services you may be exposed to Content that is offensive and/or indecent. Targetline Limited will not be liable in any way for any Content or for any loss or damage of any kind resulting from the use of any Content transmitted via the Services and you agree to bear all risks associated with the use of any Content, including any reliance on the accuracy or completeness of such Content.

3.6.2 In using the Website/Services you agree not to:

Targetline Limited has the right to terminate your access to any or all of the Services at any time, without notice, for any reason, including without limitation, breach of these Terms and Conditions. Targetline Limited may also at any time, at its sole discretion, discontinue the Website/Services or any part thereof without prior notice and you agree that Targetline Limited shall not be liable to you or any third party for any termination of your access to the Website/Services.

3.8 LINKS TO THIRD PARTY WEBSITES

The Website/Services may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that Targetline Limited is not responsible for the content or availability of any such sites.

You agree to indemnify and hold Targetline Limited and its employees and agents harmless from and against any breach by you of these Terms and Conditions and any claim or demand brought against Targetline Limited by any third party arising out of your use of the Services and/or any Content submitted, posted or transmitted through the Services, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by Targetline Limited in consequence of your breach of these Terms and Conditions.

3.12 DISCLAIMERS AND LIMITATION OF LIABILITY

3.12.1 Use of the Website/Services is at your own risk. The Website/Services are provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

3.14 GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.

4.1 Targetline Limited is committed to protecting your privacy and maintaining the security of any personal information received from you. We strictly adhere to the requirements of the data protection legislation in the UK. The purpose of this statement is to explain to you what personal information we collect and how we may use it.

4.2 When you order, we need to know your name, address, email address and card details. This allows us to process and fulfil your order. You have the option to withhold personal information that is not required for the order process.

4.3 We use your personal information to update you about new products/services.
